Conditions of participation

for Thomas-Krenn.AG competitions

Participation in online competitions on the platforms of Thomas-Krenn.AG and their implementation are governed by the following provisions.

§ 1 Sweepstakes
(1) These campaigns are in no way connected to the various social media platforms (Facebook, Twitter, Google+, LinkedIn, Xing, YouTube) and are in no way sponsored, supported or organized by them. The recipient of the data provided by the participants is not the aforementioned social media portals, but Thomas-Krenn.AG. The data provided will only be used to contact the winner and administer the prize. Questions, suggestions and complaints should therefore be addressed exclusively to Thomas-Krenn.AG. In addition, the operator may contact the participant by email.
(2) A participant takes part in the competition by solving the tasks listed in the respective competition concept or fulfilling the conditions of participation during the competition period. Participation must take place within the period specified in the competition. The participant is responsible for the accuracy of his/her e-mail and/or postal address in particular. The electronically logged receipt serves to verify compliance with the deadline.

§ 2 Participants
(1) Persons aged 18 and over are eligible to participate.
(2) In order to participate in the competition, it is essential that all personal details are truthful. Failure to do so may result in exclusion in accordance with § 3 (4).

§ 3 Exclusion from the competition
(1) Employees of Thomas-Krenn.AG, the participating cooperation partners and their relatives are excluded from participation.
(2) Thomas-Krenn.AG reserves the right to exclude persons from the competition in the event of a breach of these conditions of participation.
(3) Persons who use unauthorized aids or otherwise gain advantages through manipulation are also excluded. In such cases, prizes may also be subsequently withdrawn and reclaimed.
(4) Persons who provide false personal details will also be excluded.
(5) Persons living outside the Federal Republic of Germany will also be excluded.

§ 4 Implementation and processing
(1) The winners will be notified by Thomas-Krenn.AG in writing by post and/or email and may be published/mentioned by name on the social media portals of Thomas-Krenn.AG and/or the website of the respective cooperation partners. The winner expressly agrees to this form of publication. Thomas-Krenn.AG is entitled to transmit the winner's data to the cooperation partners in order to enable the delivery of the prize. If Thomas-Krenn.AG only knows the winner's e-mail address, the winner will be notified by e-mail. If the winner does not respond with their full postal address within four weeks of the notification being sent, the claim to the prize will be forfeited and a new winner will be drawn by lot. The claim to the prize shall also be forfeited if the prize cannot be sent within 6 months of the first notification of the prize for reasons attributable to the winner.
The item presented as a prize in the competition is not necessarily identical to the item won. In fact, there may be differences in terms of model, color, etc. The prize sponsor may select an item of medium type and quality equivalent to the item presented as a prize.
(2) The non-cash prizes will be sent by Thomas-Krenn.AG or the sponsor or a third party commissioned by Thomas-Krenn.AG or the sponsor by forwarding agent, parcel service or post to the postal address to be provided by the winner.
Delivery will only be made within the Federal Republic of Germany. Delivery is free of charge.
(3) If the prize cannot be sent or can only be sent under unreasonable circumstances, the winner will receive an equivalent replacement.
The winner will also receive an equivalent replacement if the original prize is no longer available in the version presented (model change, seasonal goods, etc.).
(4) A cash payment of the prize or any prize replacement is not possible under any circumstances.
(5) The claim to the prize or prize replacement may not be assigned.
(6) Complaints relating to the execution of the competition must be submitted in writing to Thomas-Krenn.AG within 14 days of the reason for the complaint becoming known. Complaints made by telephone or late complaints will not be processed.

§ 5 Premature termination of the competition
Thomas-Krenn.AG reserves the right to cancel or terminate the competition at any time without prior notice and without giving reasons. Thomas-Krenn.AG makes use of this option in particular if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons, the proper execution of the game cannot be guaranteed. If such a termination is caused by the behavior of a participant, Thomas-Krenn.AG may demand compensation from this person for the damage incurred.

§ 6 Data protection
(1) In order to participate in a competition, it is essential to accept the applicable privacy policy. The participant is free at any time to revoke their consent to storage and thus withdraw from participation.
(2) All personal data provided by the participant will only be collected and processed to determine the winner. This data will be completely deleted after the end of the current competition and will not be used by Thomas-Krenn.AG for further advertising purposes or other contact.

§ 7 Liability
(1) Thomas-Krenn.AG is released from all obligations when the prize is handed over, unless an earlier point in time results from these regulations.
(2) Thomas-Krenn.AG is not liable for material defects and/or defects of title in the prizes donated by the partner.
(3) Thomas-Krenn.AG is not liable for the insolvency of a partner or the resulting consequences for the execution of the competition.
(4) Thomas-Krenn.AG is only liable for damages caused by Thomas-Krenn.AG or one of its vicarious agents intentionally or through gross negligence or through the negligent breach of obligations that are essential for achieving the purpose of the contract. These limitations do not apply to damage caused by injury to life, limb and/or health or to liability under the Product Liability Act. The above limitations of liability also apply in particular to damage caused by errors, delays or interruptions in transmission, faults in the technical systems and service, incorrect content, loss or deletion of data or viruses.

§ 8 Severability clause
Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Terms and Conditions of Participation. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic meaning and purpose of the invalid provision. The same applies in the event of a loophole in these conditions of participation.
